These Terms of Service ("Terms") govern your access to and use of the DateNova mobile application and the features and services made available through it (collectively, the "Services").
The Services are provided by DateNova Team ("DateNova," "we," "our," or "us").
Please read these Terms carefully. By creating an account, accessing DateNova, or using any part of the Services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not create an account or use the Services.
1. DateNova Is for Adults Only
DateNova is designed exclusively for adults.
You may create an account and use the Services only if:
You are 18 years of age or older;
You have the legal capacity to enter into these Terms;
You are legally permitted to use the Services in your country or region;
You are not prohibited from using the Services under applicable law.
By registering for DateNova, you represent and warrant that you satisfy all of these requirements.
Providing false information about your age or allowing a minor to access DateNova through your account is strictly prohibited.
We reserve the right to request reasonable information necessary to verify that a user meets our age requirements.
2. Protection of Minors
Protecting minors is an important part of DateNova's safety standards.
Individuals under the age of 18 are not permitted to register for, access, or use DateNova.
Users must not:
Help or encourage a minor to create a DateNova account;
Allow a minor to use their account;
Falsely represent the age of a minor;
Use DateNova to identify, approach, contact, groom, exploit, or otherwise endanger a minor;
Request inappropriate content from a minor;
Share content that sexually exploits or abuses minors;
Promote or facilitate sexual exploitation of children.
If we reasonably believe that an account belongs to an individual under 18, we may immediately restrict or suspend that account while the matter is investigated.
Confirmed underage accounts may be permanently terminated.
Users who become aware of a suspected underage account should report it through DateNova's in-app reporting functionality or contact:
3. Child Sexual Abuse and Exploitation
DateNova maintains a zero-tolerance policy toward child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM).
You must never use DateNova to create, upload, possess through the Service, request, solicit, distribute, transmit, advertise, promote, or facilitate:
Child sexual abuse material;
Sexualized content involving minors;
Content that facilitates or encourages the sexual exploitation of children;
Grooming or predatory behavior toward minors;
Attempts to obtain sexual content from minors;
Links or directions to services or locations containing CSAM;
Any other activity involving the sexual abuse or exploitation of a child.
This prohibition applies regardless of whether the material is shared publicly or through private communications.
When we identify or receive a credible report of suspected CSAE or CSAM, we may take immediate action, including:
Removing or restricting access to the content;
Suspending the associated account;
Permanently terminating the account;
Preserving relevant account or content information where appropriate;
Taking measures designed to prevent repeated violations;
Reporting suspected illegal conduct to competent authorities or appropriate child-safety organizations when required by applicable law.
Attempts to circumvent these safeguards may also result in permanent account termination.
4. Your DateNova Account
Some features require you to create and maintain a DateNova account.
When creating an account, you agree to provide information that is accurate, current, and not intentionally misleading.
You are responsible for:
Protecting your login credentials;
Maintaining control over your account;
Keeping relevant account information current;
Activity performed through your account.
You should notify us promptly if you believe another person has gained unauthorized access to your account.
You may not:
Sell, rent, or transfer your account;
Give another person access to your account;
Create an account using another person's identity without authorization;
Use automated methods to create accounts;
Create replacement accounts to avoid a suspension or ban.
We may restrict accounts that appear compromised until appropriate security measures have been completed.
5. Profiles and Authenticity
DateNova allows users to create profiles to introduce themselves and connect with others.
You are responsible for ensuring that information you provide about yourself is not materially deceptive.
You must not:
Impersonate another individual;
Use another person's photographs without permission;
Intentionally misrepresent your identity for fraudulent purposes;
Create fake profiles to scam, manipulate, or harm others;
Claim an affiliation with another person or organization when none exists.
We may remove misleading profile information or restrict accounts where we reasonably believe that deceptive activity has occurred.
6. Using DateNova Responsibly
You agree to use DateNova only for lawful purposes and in a manner that respects the rights and safety of others.
You must not use the Services to:
Harass, bully, threaten, or stalk another person;
Encourage violence or credible threats of harm;
Promote hatred or unlawful discrimination;
Commit or facilitate fraud;
Conduct phishing or other scams;
Blackmail or extort another person;
Send malicious software or harmful links;
Obtain personal information through deception;
Send repetitive spam or unauthorized commercial solicitations;
Interfere with DateNova's technical systems or security mechanisms;
Use bots, scripts, or unauthorized automated systems to manipulate the Services;
Circumvent restrictions placed on your account.
Conduct that occurs through private messages remains subject to these Terms.
7. Your Content
DateNova allows users to submit information and content, including profile information, photographs, videos, messages, and other materials ("User Content").
You retain any ownership rights you have in your User Content.
By submitting User Content through DateNova, you grant DateNova Team a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, and transmit that content to the extent reasonably necessary to:
Operate the Services;
Deliver content to its intended recipients;
Maintain and secure DateNova;
Investigate reports and policy violations;
Improve the functionality of the Services;
Comply with applicable legal obligations.
This license ends when the relevant content is deleted from our active systems, except where continued processing or retention is reasonably necessary for legal, security, backup, enforcement, or safety purposes.
You represent that you have the rights and permissions necessary to submit any User Content you provide.
8. Content That Is Not Allowed
In addition to the child-safety restrictions described above, you must not use DateNova to submit, send, promote, or distribute content that:
Is illegal;
Contains credible threats or promotes serious violence;
Encourages terrorism or violent extremist activity;
Promotes hatred against protected groups where prohibited by applicable law or our policies;
Contains non-consensual intimate imagery;
Violates another person's privacy;
Infringes copyrights, trademarks, or other intellectual property rights;
Facilitates fraud, scams, or identity theft;
Contains malware, phishing material, or malicious code;
Promotes illegal goods, services, or activities;
Is intended to seriously harass or intimidate another user.
We may remove or restrict content that violates these Terms.
Serious or repeated violations may result in account suspension or permanent termination.
9. Private Messages and User Interactions
DateNova enables users to communicate directly with one another through private messaging features, including supported text and media formats.
You are responsible for your own communications and decisions when interacting with other users.
DateNova does not guarantee:
The identity of another user;
The accuracy of information another user provides;
Another user's intentions;
That every interaction will be appropriate or safe;
That an online interaction will result in a relationship or offline meeting.
Use reasonable caution before sharing information such as your home address, financial information, identification documents, passwords, or other sensitive information.
If another user makes you uncomfortable or behaves inappropriately, you may stop communicating with that user and use DateNova's blocking or reporting features.
10. Reporting and Blocking
DateNova provides safety tools that allow users to report content or accounts and block unwanted interactions.
You may submit reports involving issues such as:
Harassment;
Threats;
Fake or deceptive profiles;
Fraud or scams;
Inappropriate content;
Non-consensual intimate content;
Suspected underage users;
Child safety concerns;
Other violations of these Terms.
Blocking another user may prevent or restrict future interactions between the relevant accounts, depending on the functionality available in the Services.
We may review information reasonably necessary to investigate a report and determine whether enforcement action is appropriate.
Do not knowingly submit false reports for the purpose of harassing or retaliating against another user.
11. Moderation and Enforcement
DateNova may use automated systems, human review, user reports, technical signals, or a combination of these methods to help identify violations.
Depending on the nature and severity of a violation, we may:
Remove content;
Reduce or restrict access to certain functionality;
Issue a warning;
Temporarily suspend an account;
Permanently terminate an account;
Prevent creation of replacement accounts;
Preserve relevant records;
Take other measures reasonably necessary to protect users or the Services.
Not every violation can be identified immediately, and our moderation systems do not guarantee that all harmful or inappropriate content will be detected.
Users remain responsible for their own conduct and User Content.
12. Premium Features
DateNova may offer optional paid features that provide additional functionality or access within the Services.
Premium features may include:
Membership or VIP benefits;
Enhanced discovery or profile features;
Additional communication features;
Access to certain premium functionality;
Other paid benefits offered from time to time.
The specific features included in a paid offering will be displayed before you complete the applicable purchase.
We may add, modify, or discontinue premium features as the Services evolve, subject to applicable law.
13. Subscriptions
Certain premium features may be offered through recurring subscription plans.
Before purchasing a subscription, you will be shown relevant information such as the subscription price, billing period, and included benefits.
If you purchase a recurring subscription through Google Play or another authorized payment provider, the subscription may automatically renew at the end of each billing period unless you cancel it before the applicable renewal deadline.
Subscription management and cancellation may be handled through the platform or payment provider through which you originally subscribed.
Deleting your DateNova account or uninstalling the application does not necessarily cancel an active subscription.
You are responsible for managing your subscription through the applicable payment provider.
Following cancellation, you may generally continue using the applicable subscription benefits until the end of the current paid billing period, unless otherwise stated or required by applicable law.
14. Purchases and Paid Digital Features
DateNova may make digital services, features, or other digital benefits available for purchase.
The price and applicable terms of a purchase will be displayed before you confirm the transaction.
By completing a purchase, you authorize the applicable payment provider to charge the displayed amount using your selected payment method.
Digital purchases:
Are intended for personal use within DateNova;
Do not represent deposits, investments, or stored monetary accounts;
Cannot be transferred between users unless a DateNova feature expressly permits such transfer;
Cannot be redeemed for cash unless required by applicable law.
We may modify the availability or pricing of future purchases at any time. Changes to future prices do not retroactively change completed transactions.
15. Unlockable Digital Content
Certain content or experiences within DateNova may require a separate purchase, entitlement, or other digital access mechanism before they become available.
Where a user chooses to unlock digital content, the applicable price or required digital entitlement will be presented before the transaction is confirmed.
After a successful transaction, the applicable content will be made available according to the terms presented at the time of purchase.
Unlocking content does not transfer ownership of that content to you. Unless otherwise stated, you receive a limited, personal, non-exclusive, non-transferable right to access the applicable digital content through the Services.
You may not:
Circumvent an unlock or payment mechanism;
Exploit technical vulnerabilities to obtain paid content without authorization;
Redistribute paid content for commercial purposes;
Sell access to content obtained through your account;
Use unauthorized software or methods to manipulate purchase records.
We may revoke access obtained through fraud, unauthorized payment activity, technical exploitation, or other violations of these Terms.
16. Refunds and Billing Issues
Purchases made through an application marketplace or external authorized payment provider may be subject to that provider's billing, cancellation, and refund rules.
Where Google Play processes a transaction, applicable refund requests may be handled in accordance with Google Play's policies and applicable law.
If you believe that a transaction associated with your DateNova account is incorrect, unauthorized, or otherwise problematic, you may contact the relevant payment provider or DateNova support.
Nothing in these Terms limits refund, cancellation, or other consumer rights that cannot lawfully be waived in your jurisdiction.
17. Promotional Offers
From time to time, DateNova may provide promotional pricing, trial periods, discounts, bonuses, or other special offers.
Such offers may:
Be available only to selected users;
Apply only in certain regions;
Have a limited availability period;
Be subject to additional eligibility requirements;
Be unavailable to users who previously received the same or a similar offer.
The specific terms of an offer will be presented when the offer is made available.
Unless otherwise stated, promotional benefits have no cash value and cannot be transferred between accounts.
18. Intellectual Property Rights
DateNova and its licensors retain all rights in and to the Services other than User Content owned by individual users.
This includes rights associated with:
The DateNova application;
Software and source code;
Interface and interaction designs;
Graphics and visual elements;
Logos and brand elements;
Databases;
Text created by DateNova;
Features and functionality;
Proprietary technology.
Subject to your compliance with these Terms, DateNova grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purposes.
You may not, except where applicable law expressly permits otherwise:
Copy or reproduce substantial portions of the Services;
Modify or create unauthorized derivative works;
Sell, sublicense, or commercially redistribute the Services;
Reverse engineer or attempt to extract source code;
Remove copyright, trademark, or proprietary notices;
Use DateNova's branding without authorization.
19. Copyright and Rights of Others
You must respect the intellectual property and other legal rights of other people.
Do not upload or distribute content through DateNova unless you own the relevant rights or have appropriate authorization to use it.
If we receive a valid complaint alleging infringement, we may investigate the relevant content and take appropriate action, which may include:
Removing or restricting the content;
Requesting additional information;
Warning the account holder;
Restricting or terminating accounts involved in repeated infringement.
You remain responsible for ensuring that your User Content does not violate another person's copyrights, trademarks, privacy rights, publicity rights, or other legal rights.
20. Account Suspension
We may temporarily suspend or restrict an account where we reasonably believe action is necessary to:
Investigate a reported violation;
Protect another user;
Prevent suspected fraud;
Address a security incident;
Verify eligibility or account information;
Prevent continued violations of these Terms;
Comply with applicable legal requirements.
During a suspension, some or all DateNova features may become unavailable.
A temporary suspension does not guarantee that an account will subsequently be restored.
21. Account Termination
DateNova may permanently terminate an account for serious or repeated violations.
Examples of conduct that may result in termination include:
Using DateNova while under 18;
Child sexual abuse or exploitation;
Sharing or soliciting CSAM;
Serious harassment or credible threats;
Fraud or scams;
Non-consensual intimate content;
Repeated creation of fake or deceptive profiles;
Circumventing previous account enforcement;
Manipulating payment systems;
Serious or repeated violations of these Terms.
Depending on the severity of the conduct, termination may occur without prior warning.
Following termination, your authorization to access the Services ends.
We may take reasonable technical or operational measures to prevent users who have been permanently banned for serious violations from creating replacement accounts.
22. Closing Your Own Account
You may stop using DateNova and request closure of your account at any time.
Account deletion does not automatically cancel an active subscription purchased through a third-party application marketplace or payment provider.
You should separately manage or cancel any active recurring subscription through the provider used to purchase it.
Following account deletion, information will be handled according to the retention and deletion provisions described in our Privacy Policy.
23. Changes to the Services
DateNova is continually evolving.
We may introduce, modify, replace, or discontinue features where reasonably necessary for purposes such as:
Improving user experience;
Maintaining security;
Addressing technical requirements;
Responding to user feedback;
Meeting legal or regulatory obligations;
Developing new functionality.
We do not guarantee that every feature will remain available indefinitely.
Where a change materially affects an existing paid service, we will comply with applicable consumer protection requirements.
24. Service Availability
We aim to keep DateNova available and functioning properly, but we cannot guarantee uninterrupted operation.
Access may occasionally be affected by:
Maintenance;
Software updates;
Network problems;
Infrastructure failures;
Security incidents;
Third-party service disruptions;
Events outside our reasonable control.
We may temporarily restrict access where necessary to protect the security, integrity, or stability of the Services.
25. Interactions With Other Users
DateNova provides tools that allow adults to discover and communicate with other users. We do not control the actions of individual users and cannot guarantee that information provided by another user is accurate or complete.
You are responsible for deciding how and whether to interact with another user.
If you choose to meet another user in person, you should take reasonable safety precautions, including meeting in an appropriate public location and informing someone you trust about your plans.
You should never send money or provide financial credentials to another user based solely on an interaction through DateNova.
DateNova is not responsible for conduct that occurs outside the Services, except to the extent responsibility cannot be excluded under applicable law.
26. No Guarantee of Matches or Relationships
DateNova provides features intended to help users discover and communicate with other adults.
We do not guarantee:
That you will receive a particular number of matches, likes, messages, or profile views;
That another user will respond to your messages;
That recommendations will meet your preferences;
That another user's profile information is completely accurate;
That communications will develop into a friendship, relationship, or other connection;
Any particular outcome from using paid or unpaid features.
Purchasing a subscription, premium feature, or digital content does not guarantee increased interactions or any particular social or relationship outcome.
27. Disclaimer of Warranties
To the maximum extent permitted by applicable law, DateNova is provided on an "AS IS" and "AS AVAILABLE" basis.
DateNova Team makes no warranty, express or implied, regarding the operation, availability, reliability, accuracy, or suitability of the Services.
Without limiting the foregoing, we do not warrant that:
DateNova will operate without interruption;
The Services will always be free from errors, defects, or security vulnerabilities;
All harmful or inappropriate activity will be identified;
Information submitted by users will be accurate;
Every reported violation will be resolved within a particular period;
Any specific feature will remain available permanently.
To the extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
28. Limitation of Liability
To the fullest extent permitted by applicable law, DateNova Team and its affiliates, service providers, licensors, employees, representatives, and contractors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to your use of the Services.
This may include damages resulting from:
Loss of data;
Loss of profits or revenue;
Loss of business opportunities;
Unauthorized account access;
Service interruptions;
User Content;
Communications with another user;
Conduct of another user;
Reliance on information provided through the Services.
Where applicable law permits monetary liability to be limited, DateNova Team's total aggregate liability arising from or relating to the Services will not exceed the greater of:
The amount you paid through DateNova during the twelve (12) months immediately preceding the event giving rise to the claim; or
USD $100.
The limitations in this section apply only to the extent permitted by applicable law.
29. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless DateNova Team and its affiliates, employees, representatives, contractors, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from or related to:
Your violation of these Terms;
Your User Content;
Your unlawful use of the Services;
Your infringement of another person's rights;
Fraudulent or abusive activity conducted through your account.
This provision does not require you to indemnify DateNova for conduct for which indemnification cannot lawfully be required.
30. Third-Party Services
Certain parts of DateNova may rely on or interact with services provided by third parties, including application marketplaces, payment providers, infrastructure providers, or other technology services.
Third-party services may be governed by their own terms and privacy policies.
DateNova Team is not responsible for the independent practices of third-party services that are outside our reasonable control.
Your use of Google Play and other independent services remains subject to the applicable provider's terms.
31. Changes to These Terms
We may revise these Terms as DateNova develops or when changes are necessary to address:
New or modified features;
Changes in business operations;
Safety requirements;
Legal or regulatory developments;
Technical changes;
Other reasonable operational needs.
When these Terms are updated, we will revise the Effective Date displayed at the beginning of the document.
Where required by applicable law, we may provide additional notice before material changes take effect.
By continuing to use DateNova after revised Terms become effective, you agree to the updated Terms.
If you do not agree with an updated version, you must stop using the Services.
32. Governing Law and Consumer Rights
These Terms will be interpreted in accordance with the laws applicable to the operation of the Services, subject to mandatory laws that apply in your jurisdiction.
Nothing in these Terms is intended to remove, restrict, or waive consumer rights that cannot legally be excluded or limited.
Any dispute relating to these Terms or the Services will be handled by a court or other competent authority with jurisdiction under applicable law.
33. Severability
If any part of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible.
If it cannot be made enforceable, the affected provision will be treated as severed from these Terms.
The remaining provisions will continue in full force and effect.
34. No Waiver
If DateNova does not immediately enforce a provision of these Terms, this does not mean that we have waived the right to enforce that provision later.
A failure to exercise a right or remedy does not constitute a waiver of any other right or remedy.
35. Assignment
You may not transfer or assign your rights or obligations under these Terms to another person without our prior permission.
DateNova Team may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, transfer of the Services, or similar business transaction, subject to applicable law.
36. Entire Agreement
These Terms, together with the DateNova Privacy Policy and any additional rules or policies expressly incorporated into these Terms, constitute the agreement between you and DateNova Team regarding your use of the Services.
They supersede prior agreements or understandings concerning the same subject matter.
37. Survival
Provisions that by their nature should continue after your account is closed or these Terms otherwise cease to apply will survive termination.
These may include provisions concerning:
Intellectual property;
User Content rights;
Payment obligations;
Disclaimers;
Limitation of liability;
Indemnification;
Dispute-related provisions.
